    Liquidation basics

    When a company is unable to meet their debts as they fall due then the law requires that they liquidate. This starts a process governed by company law and the rules of the superior courts that realises company assets, identifies company liabilities and reviews the conduct of the directors.

    Monies raised on the realisation of assets is set against company liabilities in a sequence laid down by statute after costs are approved by the creditors. At the same time, the conduct of the directors is reviewed to ensure they acted in an honest and reasonable way. Once done the liquidation is finalised.
